Although many Moroccans work under the table, without a contract, without social protection, one should not think that labour law is non-existent.
On the contrary, and it is applied much more severely to foreigners, whether they are employers or employees. Of course, we are talking here about foreigners in a legal situation, and not those who live in Morocco and leave every three months for a day or two (ie. “visa run“).
They must hold the equivalent of a work permit. This requires “first” or rather simultaneously a residency permit. And by an authorisation from the Ministry of Labour, which checks, as in any European country, that the job offered to a foreigner could not be occupied by an (unemployed) Moroccan.
The employer is responsible for the whole procedure. It is compulsory to start the procedure from the dedicated website, taechir.travail.gov, and the documents have to be submitted to the local agency.
Documents to be provided to obtain authorisation
The ԁосumеntѕ to be provided are different depending on whether it is the person’s first work contract (and therefore the issuance of the residence/work permit) or a renewal.
In the case of a first application :
- Application for a approval of a foreigner’s work contract in duplicate, signed by the employee concerned
- Five original copies of the foreigner’s employment contract
- Diplomas obtained and work certificates justifying the employee’s experience
- Copies of the first pages of the passport (with the lаѕt еntrу stamp in Morocco)
- Certificate, issued by ANAPEC (National Agency for the Promotion of Employment and Skills), certifying the absence of national candidates to occupy the position offered to the foreign employee.
In the case of a renewal:
- Application for a foreigner’s employment contract visa in duplicate, signed by the employee concerned
- Five original copies of the fоrеіgnеr‘s employment contract
- Certificate issued by the National Social Security Fund (CNSS) justifying the last three months of contributions in favour of the employee concerned
- Copy of the residency card in Morocco
- Certificate, issued by ANAPEC, certifying the absence of national candidates to occupy the position offered to the foreign employee.
Exemption from certification by Anapec
In some cases, it is not necessary to provide the ANAPEC certificate certifying that there is no qualified unemployed person for the position:
- foreigners born in Morocco, or of Moroccan mothers, and resident in Morocco for more than six months
- spouses of Moroccans
- foreigners who own a company and corporate officers (to work in their own company). In the particular case of the manager of a single shareholder SARL, he/she саnnоt hаѵе an employment contract, as one cannot sign his/her own employment contract.
- expatriate employees in the context of a limited-term secondment within an international group
- expatriate employees for a limited period of time in the framework of a public contract
- development workers and members of NGOs, for periods of less than six months
- foreign artists authorised by the Direction Générale de la Sûreté Nationale
- political refugees and stateless persons

The Ministry of Employment and Vocational Training in Rabat
Until recently, you had to go to the Ministry of Employment and Training in Rabat to file the documents, regardless of the employer’s city. Fortunately, there is now an online procedure for creating a file, which became compulsory.

Unless you are married to a Moroccan woman, you’ll need to prove there is no Moroccan who could be hired for this job. Mission impossible. Or work as a non declared employee. No residence card.
