Hello, I am a foreigner and live in Morocco. To transfer my salary to a foreign account, my bank is asking me for an employment contract approved by the Ministry of Employment. What documents do I need to provide? I am the manager and employee of my company.
The mechanism for savings on salaries is subject to strict procedures, including the provision of a Foreign Employment Contract, which is the only proof of the legality of the employment.
Can you sign a contract with yourself?
Unfortunately, the Ministry of Labor refuses to issue a Foreign Employment Contract in the case of the manager of a single-member LLC, on the grounds that one cannot sign a contract with oneself.
In fact, the same person will sign the employment contract, both as an employee and as a manager.
Except that, as a manager, it is not “he” who signs the contract, but the legal entity of his company, which he represents.
Of course, it is impossible to get this argument, which is nevertheless totally legally valid, accepted by the Ministry of Labor.
Solutions?

- nommer officiellement un co-gérant, qui pourra signer le contrat de travail (même s’il n’est pas salarié par la société, ou qu’il n’est pas actionnaire).
La seconde solution est une procédure lourde, puisqu’elle passe par une Assemblé Générale Extraordinaire, une modification des statuts et une publication au Journal Officiel. De plus, elle implique d’avoir une grande confiance dans le co-gérant.
Nb : même en étant associé unique, on peut avoir un co-gérant. En effet, le gérant n’est pas obligatoirement un associé de la société ou un salarié. Néanmoins, dans le cas d’une SARL AU, cela reste un montage un peu tiré par les cheveux.
Is an employment contract still necessary?
The employment contract in the case of the manager of SARL AU is therefore a formality. It is clear that the manager has full authority to pay himself a salary and that, in practice, he is contracting with himself.
From the moment he pays himself a salary, the employment contract exists de facto (it does not need to be in writing, legally speaking).
However, it remains an administrative document that may be useful later on, for example for career reconstruction purposes.
